MINUTES MAGNOLIA VILLAGE COUNCIL REGULAR COUNCIL MEETING March 11, 2020 

The Regular Meeting of Magnolia Village Council was called to order on March 11, 2020 at 7:00 p.m. at The Magnolia Village Hall by Mayor Travis Boyd. Members present were Grant Downes, Claudia Rogers, Jessica Miller, Jim Miller, Eric White. Also present were Solicitor Kevin L’Hommedieu, Chief Hager, Paul Ciccero (Electric Aggregate), Doug Miller, Mat Hawk, Jay Herstine, and Mark Wadsworth. 

Jim Miller made a motion to excuse Scott Noble from the meeting. The motion was seconded by Claudia Rogers. All Ayes. 

VISITOR’S COMMENTS: Paul Ciccero from Trebel Energy provided information about the Electric Aggregate. The current provider is Dynegy with a fixed rate of 0.0546 through April 2020. The new provider will by Energy Harbor, with a new effective rate of 0.0439 from May 2020 though May 2023. There are currently 217 residents that are active in the program, and 96 have dropped out since the start of the program. The aggregator certificate is effective from February 23, 2019, and it expires February 23, 2021. Mayor Boyd asked what residents have to do to get into the program. Answer: all residents will receive an opt out letter in the mail. If they do join, they can opt out at any time at no charge. 

Mark Wadsworth thanked Chief Hager for contacting the residents mentioned at the last meeting to clean up their property. 

MINUTES: Jim Miller made a motion to accept the minutes from February 12 and 16 as presented. Claudia Rogers seconded the motion. All Ayes. 

FISCAL OFFICER’S REPORT: The Fund Status was read. Jessica Miller made a motion to accept, which was seconded by Grant Downes. All Ayes 

MAT HAWK’S REPORT: Mat reported that resident Jack Lidderdale had contacted the Village office regarding the broken cement in the ally apron beside his house at 495 North Main. A discussion followed regarding the repair. The cement chunks will be removed with repair to follow when the weather gets better. 

The volleyball nets will be put up soon, and Mat stated that a new net will be needed. Council asked him to check the basketball nets also. Jim Miller said that he would get the new basketball nets. 

Jessica Miller asked about the new trash cans. Mat said that one of the new ones is out and the other will be put out soon. 

ADDITIONS TO BUSINESS: Solicitor Kevin L’Hommedieu administered the Oath of Office to Water Board member Mark Wadsworth. 

Jim Miller stated that Lorrie Clevenger feels that Molly Murphy is doing well with the new job. He made a motion to pay Molly $1,100 for the month of March, which was seconded by Claudia Rogers. All Ayes. 

OLD BUSINESS: Doug Miller stated that all of the inside cameras are working. The system will be done by Friday. The park cameras should be done by the last week of March. The system will have 11 cameras when it is done. The video for the Village Hall cameras will be accessible for 3 weeks, and the video for the park will be accessible for a month. Chief Hager will have access to the camera feed from his phone. 

Mayor Boyd stated that the meeting times will be OK for council member Scott Noble. Jim Miller made a motion to continue having the monthly meetings on the second Wednesday of each month at 7:00 p.m., which was seconded by Eric White. All Ayes. 

Mayor Boyd contacted Mike Lancaster, Alan Tozzi and Grant Downes regarding zoning. They are all on board to continue working with zoning. Grant said that he and Mike have been looking at zoning regulations from other similar villages, and will have a zoning meeting soon. 

NEW BUSINESS: Boy Scout Troop 157 inquired about the possibility of putting a Library Box in the village. It will be a take and book/leave a book box. No location has been determined yet. 

Grant Downes extended an invitation to speak to the council to the person in charge of the Dark Skies program at Stark Parks – Fry Park. 

Jim Miller explained the situation with Spectrum: the village has been paying for double internet and for 3 cable boxes at an astronomical rate. He and Mike Rogers ran wiring from the police department to Molly’s office, so there is no need for two internet bills. In addition, two of the cable boxes will be returned. Jim ordered a new phone system from Ooma, which will arrive soon, and is only $19.95 per month for a business phone (and the old phone number can be switched over). Jim thanked Mike for all of his help with the project. 

COMMITTEE REPORTS 

PARKS AND PUBLIC BUILDING: The spring clean up day was discussed. It will be on Saturday, April 18 from 8:00 to Noon. Eric White will check on the trash box. 

Eric asked that people contact him with any issues with the public building. 

He contacted Muskingum Watershed regarding possible help with the pipe in the park, where the orange fencing is. It is eroding. He is also looking into replacing the roof of the pavilion and eat stand. 

SAFETY: Chief Hager read the police report. The letters for the police department arrived, and will be installed soon. 

The quarterly safety meeting was held with East Sparta. They are working on purchasing hand held radar guns. 

A discussion was held regarding “Reduced Speed Ahead Signs” for the area coming into the village from State Route 542. 

Grant Downes stated that Rose Township donated a printer to the police department. 

CEMETERY: Claudia Rogers reported that $675 was collected during February 2020. She reported that Caleb cleaned up the grass area by the curve at the top of the hill in the cemetery, where cars drove into the grass. He would like to put up stakes to keep the cars off of the grass. There are 5 to 6 tree stumps that need to be ground down in the cemetery. 

UTILITIES: No report. 

FINANCE: Jim Miller reported that the OTAS system is balanced through February. 

STREETS AND ALLEYS: Jessica Miller reported that she and Troy Hysong will be walking through the village to see what needs to be done with the roads. 

SOLICITER’S REPORT: No report 

CONSIDERATION OF ORDINANCES: Ordinance 2020-04. Motion by Jessica Miller to accept Model Ordinance 2020-04. The motion was seconded by Claudia Rogers. All Ayes. 

Grant Downes made a motion to enter into a dispatching agreement with Nimishillen Township Fire Department for 2020. The motion was seconded by Jessica Miller. All Ayes. 

ACTION ON BILLS: Grant Downes made a motion to pay bills as presented. The motion was seconded by Jessica Miller. All Ayes. 

MAYOR’S REPORT: Mayor Boyd reported that he has been attending many meetings and is getting as much information as possible. He is looking into possible grant money for the village.

SPECIAL COUNCIL MEETING February 16, 2020

The Special Meeting of Magnolia Village Council was called to order on February 16, 2020 at 4:00 PM at The Magnolia Village Hall by Mayor Travis Boyd. Members present were Grant Downes, Claudia Rogers, Jessica Miller, Jim Miller, Scott Noble and Molly Murphy. 

Grant Downes made a motion to excuse Eric White from the meeting.  The motion was seconded by Jessica Miller. All Ayes.

Jim Miller made a motion to hire Molly B. Murphy as Fiscal Officer effective 2/10/2020 at a rate of $15.00 while she is training.  Claudia Rogers seconded the motion. All Ayes.

Grant Downes made a motion to appoint Mark Wadsworth to the Board of Public affairs effective March 1, 2020.  Jessica Miller seconded the motion. All Ayes.

MAGNOLIA VILLAGE COUNCIL

REGULAR COUNCIL MEETING February 12, 2020

The Regular Meeting of Magnolia Village Council was called to order on February 12, 2020 at 7:00 p.m. at The Magnolia Village Hall by Mayor Travis Boyd. Members present were Grant Downes, Claudia Rogers, Jessica Miller, Jim Miller, Scott Noble and Eric White. Also present were Robert Leach, Stark County Commissioner Bill Smith, Solicitor Kevin L’Hommedieu, Chief Hager, Don Nicholson, Mat Hawk, JoLane and Gus Elson, and Mark Wadsworth.

VISITOR’S COMMENTS:  Former Mayor Robert Leach thanked everyone for the wonderful reception given in his honor at the Magnolia Methodist Church on Sunday, February 9, 2020.  He also presented the RPC Seminar information to the council members. It will be held at Sippo Lake on Saturday, February 29, 2020.

JoLane Elson addressed the council and reminded everyone that she and Gus donated the portrait of Richard Elson to the Village.  She passed around a history of Richard Elson to the board members. Mayor Boyd thanked them for the generous donation. It is very much appreciated.

Resident Mark Wadsworth expressed concern about the amount of trash and junk that is accumulating at various residences in the village.  A discussion followed.

NEW COUNCIL MEMBER:  Solicitor Kevin L’Hommedieu administered the Oath of Office to council member Scott Noble.

MINUTES:  Jim Miller made two corrections on the minutes as presented:  Mark Leichtamer was temporarily appointed to the water board and under new business, the WOOD from the cut trees was on the sidewalk at the corner of Harrison and North Main.  Claudia Rogers motioned and Eric White seconded to accept the minutes from the January 8, 2020 meeting as corrected. All Ayes

FISCAL OFFICER’S REPORT:  The Fund Status was read. Jim Miller made a motion to accept, which was seconded by Scott Noble. All Ayes.

MAT HAWK’S REPORT:  Mat reported that he received the street signs and he has been replacing them.  He purchased a new STOP/SLOW paddle for traffic control. He attended the pesticide recertification class in Akron.  He put some #4 limestone by the park, which will stay in place better. A discussion followed concerning the timing of the stone placement.  He is still working on the cameras in the park. The council is concerned about the amount of time this is taking, and they suggested giving the camera company a deadline.  

OLD BUSINESS:  The council discussed different meeting dates and times, since one member cannot attend on the second Wednesday of the month due to work meetings.  The discussion was tabled until more information is obtained by the council member.  

NEW BUSINESS:  The Reilly Sweeping Contract was presented and signed.  Mayor Boyd asked about village emails – whether council members could have individual ones under the realm of the village instead of using their individual accounts.  Grant Downes will look into this further.  

COMMITTEE REPORTS

PARKS AND PUBLIC BUILDING:  Jim Miller reported that lights at the basketball court need to be repaired.  He is looking for parts and is also looking for a timer for the lights.

SAFETY:  Chief Hager read the police report.  He is looking for wood letters to put on the building for the new police department location.

FIRE: Chief Nicholson presented the 2019 fire report.  The new station will be the new polling place for the Board of Elections.  They had to get new signage to comply with their requirements, but the Board of Elections will provide that signage.  

CEMETERY:  Claudia Rogers reported that there was no money collected for January.

UTILITIES:  Scott Noble was not sure what he needed to be doing for this. Jessica Miller explained what she did each month.  She checked on the street lights, and if any were out, she explained the process to him to get them fixed.

FINANCE: Jim Miller reported that the appropriation work will be done.  Lorrie Clevenger contacted Charles Harris & Associates regarding the end of the year reports, and they said that had not been contacted by anyone.  Lorrie asked for an extension so that the village would not be charged $50 per day.  

STREETS AND ALLEYS:  The oil and gas grant that we applied for did not go through because the traffic counts were questionable.  The traffic counts need to be more specific regarding times/types of traffic/the impact on the roads. The snowflake decorations will be taken down this weekend – weather permitting, and the old wreathes will be updated and fixed.  There is a possibility of getting new banners at a cost of $1,700, with a possible donation toward the cost.

Grant Downes is checking on municipal programs for road salt.

SOLICITOR’S REPORT:  No report.

CONSIDERATION OF ORDINANCES:  Ordinance 2-20-01 and 2-20-02.

ACTION ON BILLS:  Jim Miller made a motion to pay bills in the amount of $20,000.  The motion was seconded by Claudia Rogers. All Ayes.

MAYOR’S REPORT:  Mayor Boyd spoke about how nice the reception was for Mayor Leach.  He asked for continued patience from the board while he gets acclimated to the job, and expressed appreciation for everyone’s help.

REGULAR COUNCIL MEETING January 08, 2020

The Regular Meeting of Magnolia Village Council was called to order on January 08, 2020 at 7:00 PM at The Magnolia Village Hall by Mayor Travis Boyd. Members present were Grant Downes, Claudia Rogers, Jessica Miller, Jim Miller and Eric White. Also present was Solicitor Kevin L’Hommedieu, Chief Hager and Mat Hawk.

Visitor’s Comments– Mark Wadsworth was present to observe council.

Jim Miller motioned to excuse Scott Noble. Motion was seconded by Eric White. All Ayes

Reorganization of Council- The Magnolia Planning Commission will be made up of Grant Downes, Travis Boyd, Allan Tozzi, Mike Rogers and Mike Lancaster. Grant Downes will serve as President pro tempore. Travis Boyd will be the representative to the Stark County Regional Planning Commission. Grant Downes will be the representative to the Carroll County Regional Planning Commission. The Mayor, with the advice and consent of Council, appointed the following officials: Allan Tozzi-Zoning Inspector, Tim Costello- Cemetery Clerk, Donnie Nicholson-Disaster Services Director and Fire Safety Officer, Chief Hager-Street Commissioner, Travis Boyd Representative to SCOG, Janet Rogers- Member Records Commission, Jerry Schilling- Representative to Quad. Council will meet regularly on the 2nd Wednesday at 7:00 PM.

Minutes– Jim Miller Motioned and Claudia Rogers seconded to approve the minutes of the December council meeting. All Ayes.

Fiscal Officer’s Report– Fund status was read. Motion to accept by Jessica Miller and seconded by Claudia Rogers. All Ayes.

Mat Hawk’s Report– Only had to salt once during the last month. The trash cans around town have been emptied and are beginning to fall apart. Gravel is needed between the garage and the paper recycling bin. Sewer grate at Plain and Main broke. Tom Trushell will be making a new one. Village truck was in the shop for an oil leak. Caleb says the mower has about a year left. Mat would like to paint the garage when the weather breaks.

Old Business-Mark Leichtamer is willing to be temporarily appointed to the water board. Motion to appoint Mark Leichtamer was made by Jim Miller and seconded by Claudia Rogers. All Ayes.

Grant has not heard back from ODOT about purchasing salt from them.

New cameras are waiting to be installed by the technician.

New Business-Cut wood from trees is on the sidewalk on the corner of Harrison and North Main. Grant will notify property owner to have them removed.

Committee Reports:

Streets and Alleys– Snowflake project was a success. Have received many compliments from villagers. Asked Mat to check the alleys for pot holes. Quicksall has not heard from ODOT about the Oil and Gas Grant. Checking with Troy Hysong and street and crack patching.

Parks and Buildings– Lights are out at the basketball courts. Village hall exterior needs painted. Roof on the new pavilion and the eat stand needs replaced. Dave Rock will be getting quotes.

Safety– Safety statistics were provided by Chief Hager. Paid Officers had a total of 519.5 hours. East Sparta had 260.50 and Magnolia had 259. Car 2 was used for 972 miles and has 56,758 miles. Car 3 was used for 1,471 miles and has 30,658 miles. Car 4 was used for 65 miles and has a total of 109,027 miles. Car 4 was out of service most of December due to gas gage problem. There were 44 traffic stops. East Sparta had 28 while Magnolia had 16. East Sparta had 1 and Magnolia had 3 traffic arrests. There were 2 crash reports both in East Sparta. There were 31 total calls for service. East Sparta had 13 and Magnolia had 18. Magnolia had 1 Agency Assists. 

Cemetery-Claudia Rogers reported that $500 has been collected for the month. 

Utilities– Jessica Miller checked with AEP but they don’t have  LED street lights.

Finance– This year the village will be transitioning to the UAN (Uniform Accounting Network).

Solicitor’s -Kevin L’Hommedieu has no report.

Consideration of Ordinances– There were no Ordinances to approve.

MAGNOLIA VILLAGE COUNCIL

REGULAR COUNCIL MEETING December 11, 2019

The Regular Meeting of Magnolia Village Council was called to order on December 11, 2019 at 7:00 PM at The Magnolia Village Hall by Mayor Robert Leach. Members present were Grant Downes, Claudia Rogers, Jessica Miller, Jim Miller, Jim Hunter and Eric White. Also present was Solicitor Kevin L’Hommedieu, Lieutenant Six, Chief Hager, Don Nicholson, Travis Boyd and Mat Hawk.

Minutes– Claudia Rogers motioned and Jim Hunter seconded to accept the minutes from the November council meeting. All Ayes.

Fiscal Officer’s Report– Fund status was read. Motion to accept by Jim Miller and seconded by Grant Downes. All Ayes.

Mat Hawk’s Report-Mat has been busy salting the roads.

Old Business- Board of Public Affairs has two vacancies. Jay Herstine and Mark Leichtamer did not seek another term. Jay Herstine is willing to be appointed by Council. Jim Miller motioned and Claudia Rogers seconded to appoint Jay Herstine to the Board of Public Affairs. All Ayes

Snowflake installation will begin by John Spencer. Equipment needs upgraded on siren pole. A timer will be placed on the new pole at the playground side. The snowflakes will on existing service.  Two wreaths are out. Will be changing bulbs on wreaths to LED. Claudia Rogers will be changing the bows for next year.

New Business-Village council has a vacancy and Mayor Leach recommended appointing Grant Downes. Claudia Rogers motioned and Jim Hunter seconded to appoint Grant Downes to Village Council. All Ayes.

Grant Downes has reached out to other municipalities to see what zoning laws they have to help control residents not taking care of their property. The zoning committee will be meeting to come up with some proposals for council. Grant also presented our website and social media overview. The website reached over 30 thousand people. The most popular events were Canal Days, Clean Up Days and Trick or Treat.

The Christmas Tree drop off will be near the village garage. It will last until January 20.

The reception for Mayor Leach will be February 9, 2020 at the Magnolia United Methodist Church from 2:00 PM to 5:00 PM.

Committee Reports:

Finance– Made a large principal payment on the street loan. Temporary Appropriations were read for 2020. Jim Miller motioned and Jim Hunter seconded to approve the Temporary Appropriations. All Ayes.

Streets and Alleys– We are looking to see if the village can purchase salt from ODOT at a cheaper rate. Stark County sent their vacuum truck to clean the remaining catch basins.

Parks and Buildings– Stark Parks would like a letter of support for Fry Park. They are working on the Dark Sky Initiative. The wooden playground equipment needs to be removed. Dina Tozzi is trying to apply for grants to get new equipment. Would like to add a camera at the park by the fire station. Some playground equipment has been ruined by vandals.

Safety– Safety statistics were provided by Lieutenant Six. Paid Officers had a total of 428 hours. East Sparta had 218 and Magnolia had 210. Car 2 was used for 888 miles and has 55,786 miles. Car 3 was used for 1,265 miles and has 29,187 miles. Car 4 was used for 553 miles and has a total of 108,962 miles. There were 46 traffic stops. East Sparta had 28 while Magnolia had 18. East Sparta had 4 traffic arrest. Magnolia had one crash report. Magnolia had 1 OVI arrest. East Sparta had one misdemeanor arrest. There were 24 total calls for service. East Sparta had 17 and Magnolia had 7. Magnolia had 2 Agency Assists. The police department is looking into purchasing hand held radar guns. The cost range is $900.00-$1,500.00 per unit. Car 4 is showing signs that it needs to be replaced.

Cemetery-Claudia Rogers reported $900 has been collected for the month.

Utilities– Nothing to report.

Solicitor’s -Kevin L’Hommedieu has no report.

Consideration of Ordinances– 

Action on Bills– Motion by Eric White and seconded by Jim Hunter to pay the bills presented by the Fiscal Officer. All Ayes.

Mayor’s report– Captain Love from the Army Corp. of Engineers would like to have a meeting to discuss the levy. It will be at the Village Hall on December 12, at 1:00 PM. The temporary appropriations were read. Jim Miller motioned and Jim Hunter seconded to approve them. All Ayes. The 2020 Supplemental Fire contract was also presented. Grant Downes motioned and Claudia Rogers seconded to renew. All Ayes.  Mayor Leach also expressed his appreciation to the past and current council members for making his terms enjoyable.
